Just received this email from Amy Silver at the Meadowlands in response to a question I had asked about what the Big M plans to do with the purse money won in New Jersey by the alleged EPO horses. Here is what Amy wrote:
"The NJSEA applauds the New Jersey Racing Commission's out-of-competition testing program. We will defer to them as to whether Ernest Adam and Stephen Slender's licenses are still valid in NJ and will abide by their decision on the matter.
"Since the NJSEA is not a regulatory body, any purse redistribution would have to come from the NJRC, and be based on a horse's performance in NJ, not in other jurisdictions. [It should be noted that, of the horses listed as having tested positive in today's release, only one has recently been racing in NJ]."

Since the EPO positives were the result of out-of-competition testing, rather than testing run immediately pre- or post-race, off the top of my head it appears as though it would be difficult to DQ a horse from any specific race and redistribute the purse. Perhaps it could be done for a race that was held after the date the blood was drawn, but in my opinion there is no way to do anything about races held before the blood was pulled.
