On April 2 the Ontario Racing Commission ruled that the results of the 2008 Canadian Pacing Derby should stand as posted by the judges at Mohawk Raceway the night of the race, when they ruled that Won The West be placed from second to fourth for going inside two pylons during the stretch drive.
The ruling of the judges that night elevated Western Shore from second to third and Eagle Luck from fourth to third. Mister Big was the winner of the race.
Ron Parsons, trainer of Won The West for the Mickey Burke Stable in Canada, appealed the judges' decision, and on Jan. 14, an ORC Board of Appeals reversed the placings, putting Won The West second. Then the owners of Western Shore and Eagle Luck appealed, which prompted another review and the April 2 decision.
