Bulletproof hearing set for New Jersey

On Friday, harnessracing.com spoke with Andrew Goodman, Esquire, the attorney for plaintiffs Jeffrey Brooks and Bulletproof Enterprises in their federal lawsuit against the USTA and members of the New York State Racing and Wagering Board.  Both the USTA and New York State have indefinitely stayed the ban against Bulletproof Enterprises so Bulletproof can now race horses in New York State.

 

According to Goodman, there is presently a hearing scheduled for Tuesday, April 27, in New Jersey to determine whether Bulletproof horses will be allowed to race in that state.  The hearing will be before a judge of the New Jersey Racing Commission.

 

Meanwhile, Pennsylvania has also entered a stay of the ban, allowing Bulletproof horses to race at Pennsylvania racetracks as well, according to Goodman. Finally, with respect to the original Ontario Racing Commission ban in Canada, Goodman, who does not represent his clients in Canada, simply stated that discovery is ongoing in Canada but no date for a hearing has been set.

 

Bulletproof reportedly has 49 two year olds in training in Florida, and since baby races will start soon and then there will be big-money races, some kind of decision will have to be reached so that Bulletproof will either be allowed to race their horses in Canada. If not, Bulletproof can look at legal options and decide what to do.--By Steve Kallas
