According to published reports, Walter Case Jr, who has been in prison four years for stabbing his estranged wife with a steak knife, was approved by an Ohio Court of Common Please judge on Monday for early release, but the state of New York, where Case would go for a probationary period, must still approve. Case, who still has about eight months left for the full sentence, would be released under the supervision of his brother, trainer Tim Case, who he would work for in the hopes of regaining a racing license.

"The judge has ordered another hearing for Oct. 27," Case’s attorney, Lawrence Whitney, told Dave Little of the New York Daily News.  "And he is going to let him out if the folks in Orange County, N.Y., will accept him as a probationer. During the hearing, the judge thought that our program was a good program. That it was beneficial to Walter and his ex-wife (Nadine), given that he would be in New York and she in Ohio."

The Daily News story states Case has become a dog trainer while in prison, teaching the animals to help the handicapped. He has also been attending programs for substance abuse and anger-management issues. According to Case’s lawyer, the horseman would have to undergo counseling for alcohol, drugs and anger management after being transferred to New York for the probationary period.
