Daley, Victors file suit

The scratching of four Noel Daley-trained horses at Indiana Downs in mid August has led to a lawsuit filed on behalf of Daley and owner Adam Victor & Son Stable against the Indiana Horse Racing Commission and its executive director, Joe Gorajec.

Daley had shipped the horses, including Kentuckiana Stallion Management Stakes entries Irene's Lucky Lady, Cantor's Daughter and Little Miss Dragon, to Indiana Downs, but when he turned in his license application it was turned down by the Commission. All the horses were then scratched.

The lawsuit alleges Daley and the Victors were denied their rights under the U.S. Constitution. It alleges Daley was denied due process of the law, pointing out that the trainer was not under suspension at the time.
