Florida slots lawsuit alive

The South Florida Sun-Sentinel has reported that a lawsuit challenging voter approval of a state constitutional amendment permitting slot machine gambling in Broward Count county was reinstated Tuesday by an appellate court.

The story said that a three-judge panel of the 1st District Court of Appeal ruled 2-1 that a favorable popular vote does not automatically validate a defective constitutional amendment except for minor, technical defects.

The lawsuit was filed by the Humane Society of the United States and GREY2K USA, which believes slot machines at Broward County pari-mutuel facilities will cause the continuation of Greyhound racing. Greyhound racing takes place at Hollywood Greyhound Track located between Fort Lauderdale and Miami.

The lawsuit alleges that slot supporters submitted thousands of forged signatures in order to get the slots measure on the 2004 ballot.

“These assertions are not minor, technical defects,'' wrote Judges Ricky Polston and Paul Hawkes in the majority opinion.

Pompano Park is in the midst of construction for its slots facility.
