Judge hears lawsuit

On Wednesday in New Jersey, a United States District Court judge granted a show cause order returnable March 2 on a lawsuit by the Standardbred Breeders and Owners Association of New Jersey against the New Jersey Sports & Exposition Authority (NJSEA) for issuing an exclusive contract to Television Games Network (TVG) to broadcast and accept interstate wagers on Meadowlands harness races.

The Standardbred Breeders and Owners Association of New Jersey (SBOA) claims in its lawsuit that the New Jersey Sports & Exposition Authority violated harness horsemen’s rights under the Interstate Horse Race Wagering Act of 1978 by awarding the contract without its approval.

At the March 2 hearing, the Sports Authority and TVG will be asked to demonstrate why a preliminary injunction should not be granted to stop the exclusive contract that took effect this month.

U.S. District Court Judge Mary L. Cooper also declined to issue a temporary restraining order to stop the TVG signal and wagering, stating that there was no urgency to act immediately. Action on a motion by the Sports Authority to dismiss the SBOANJ lawsuit was deferred until the March 2 hearing date. (SBOA of New Jersey press release)
