New York track to reopen

Tioga Downs appears headed for its planned June 9 opening after the New York State Racing and Wagering Board issued a temporary, conditional track license to Nevada Gold Inc., operators of Tioga Downs, on Wednesday, April 26.

In a release issued by the Racing and Wagering Board, "the granting of a simulcast license and issuance of race dates will be conditioned upon Nevada Gold Inc. meeting the stipulations set forth in their temporary conditional track license."

“This Board action will enable Nevada Gold to make progress on the (video lottery terminal) construction project, simultaneously, while it works to meet specific conditions to open for live harness horseracing at Tioga Downs,” Board chairwoman Cheryl Buley said. “Racing and pari-mutuel wagering operations will be in compliance with state law well before the first betting window opens at this beautiful new facility.”

Board approval for the conditional temporary license requires Nevada Gold, Inc. to be in compliance with the racing law and regulations and Board directives. In summary, Nevada Gold Inc., must:

Successfully demonstrate that construction of the racing and simulcast facilities have been completed in compliance with plans that were approved by the Board, and upon completion must meet Board staff inspection thereof;

Demonstrate that all tote systems used for pari-mutuel betting or display are approved by the New York State Tax Commission;

Show no change in management or any beneficial interest, direct or indirect, in debt or equity related to the ownership, debt, or operation of the track, nor to the officers or directors of the applicant including affiliates, lenders and owner(s) without Board approval;

Place restrictive wording on the stock certificates to ensure individual stock holders are aware of racing law requirements and that the Board is properly notified of any change in ownership;

Secure the appropriate pari-mutuel bond as required under the racing law; and

Submit plans for security personnel and surveillance cameras, badge system, and natural disaster and fire evacuations. (New York State Racing and Wagering Board)
