OHHA sues Windsor

The Ontario Harness Horse Association has launched a class action suit against Windsor Raceway, claiming $10 million in damages resulting from the Raceway's closure in early January 2005 and its failure to schedule 153 days of live racing, thereby breaching its agreement with the horsemen.



In a release issued by the OHHA, it states that the suit claims that the Raceway failed to meet its responsibility to local horsemen--the people who breed, train, race and support race horses in Windsor and Essex County--when it failed to file for its license renewal in a timely fashion late last year.



The late renewal filing, and a subsequent conflict with the Ontario Racing Commission, resulted in a two-week delay in the reopening of the track for the 2005 season. Racetrack management had promised the horsemen a longer racing schedule of 153 days in 2005 in exchange for concessions made to the track in 2004.



The suit further alleges that Windsor Raceway made wrongful use of trust funds earmarked for the OHHA and for horsemen. The suit alleges that the Raceway used these funds, approximately $1 million, for its own purposes and benefit.
