Woodbine Entertainment Group’s (WEG) appeal in regard to its rejecting of horses trained by Bill Elliott and owned by Bob Hamather, Lloyd Nicholson, Gary Smith and Geoffrey Mount was dismissed Wednesday by the Court of Appeal for WEG had barred horses trained by Elliott after one of his horses tested positive for EPO. The owners appealed the ruling to the Ontario Racing Commission (ORC) which ruled that WEG could not reject those horses on a permanent basis.
WEG appealed that ruling to the Court of Appeal, which dismissed the case on Wednesday. The Court will now give WEG written reasons for the decision, and then WEG will have the option of taking the case one step further to the Ontario Supreme Court.
