PA track ruling appealed

Pennsylvania's executive branch has appealed to the Pennsylvania Supreme Court a lower court decision which ruled that the Pennsylvania State Harness Racing Commission should reconsider the Bedford Downs racetrack application.

Earlier this month the Commonwealth Court ruled that the Harness Racing Commission should reconsider its rejection of Bedford Downs, a planned one-mile harness track that would be built west of New Castle near the Ohio border.The court also said the commission didn't have to offer the same reconsideration to Valley View Downs, a proposed Beaver County racetrack, which is closer to Pittsburgh than Bedford Downs. The Valley View Downs principals included Centaur Racing, which owns an interest in Hoosier Park.

Tuesday, June 27, the state appealed to the Supreme Court. According to the Pittsburgh Post-Gazette, though the decision technically is being appealed by the Harness Racing Commission, the names of executive branch's attorneys--Barbara Adams and Gregory Dunlap--appear on top of the appeal petition.

The petition asks the Supreme Court to rule that Commonwealth Court wrongly overruled the harness commission's "expertise and judgment."
