A hearing officer in Kentucky has upheld a judge’s prior ruling regarding Loyal Opposition’s positive test for Banamine following her win in the 2005 Allerage Farm Series final at The Red Mile, which means owner Daniel Waxman will have to return the $40,000 winner’s money so that it may be redistributed.

“From the Kentucky Racing Authority’s standpoint this is over with,” the Authority’s director of Standardbred racing Marc Guilfoil told harnessracing.com. “The hearing officer recommended to uphold the judge’s decision after an appeal was made and the Racing Authority has taken the recommendation and upheld the final ruling that Loyal Opposition be disqualified and the $40,000 purse money be returned and redistributed.”

With the disqualification, Glowing Report is now considered the winner of the $80,000 final. Valley Electric moves up to second, with Stonebridge Kisses, Carolina Sunshine and Princess Justice now elevated to third, fourth and fifth, respectively.

Trainer Erv Miller also received a $250 fine for the positive for the Class 4 drug, and that too was also upheld in the decision.

Waxman, who has since sold the now-retired three-time Dan Patch Award-winning mare to Diamond Creek Farm, still has an avenue of appeal through the Franklin County Circuit Court.
