The federal Department of the Interior has ruled that the 1993 gaming compact between the Oneida Indian Nation and then New York Governor Mario Cuomo is valid, thus allowing Turning Stone Resort Casino, located near Vernon Downs, to remain open.
A letter from associate deputy secretary of the Interior James Cason to the Oneida Nation stated, “After a proposed compact is submitted for review, the IGRA (Indian Gaming Regulatory Act) requires the Department to approve or disapprove the compact within 45 days. If the Secretary does not act within 45 days, the IGRA provides that the compact 'shall be considered to have been approved.'" The letter also stated that the IGRA has no process to revoke an approved compact after the 45-day review period and that any challenges should have been made within six years of publication, which would have been June 16, 1999. “Since no one challenged the secretary's decision in a timely manner or in the proper forum, the 1993 compact continues to be in effect for purposes of the IGRA," the letter went on to state.
