The Ohio Roundtable group has filed an appeal of its lawsuit which challenges the constitutionality of video lottery terminals at the state's racetracks. The group filed its appeal in the Court of Common Pleas in Franklin County on Thursday (June 28).
On May 30 a Franklin County judge tossed out a lawsuit. Judge Timothy S. Horton, of the Franklin County Court of Common Pleas wrote, in part, "(The judiciary) operates within certain boundaries and should not be used wantonly and/or for political or social gain. Throughout their pleadings and oral arguments, plaintiffs (the Ohio Roundtable) have offered little more than bare assertions of harm or injury. Given plaintiffs' dearth of support, the court questions plaintiffs' real purpose in bringing these claims.”
